1. Overview and Acceptance
This website is operated by RV & Auto Parts Inc. Throughout these Terms of Service, “RV & Auto Parts,” “RVAutoParts.com,” “we,” “us,” and “our” refer to RV & Auto Parts Inc.
These Terms govern your access to and use of RVAutoParts.com, including purchases made through our website. By visiting our website, creating an account, submitting an order, or using our services, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the website or submit an order.
2. Eligibility and Acceptable Use
You must be legally capable of entering into a binding agreement to make a purchase. You agree to use the website only for lawful purposes and not to:
- Provide false, misleading, fraudulent, or unauthorized information;
- Use another person’s identity or payment method without authorization;
- Interfere with the website’s security, systems, or operation;
- Copy, scrape, reproduce, or commercially exploit website content without permission; or
- Use automated or coordinated activity to exploit pricing, promotional, inventory, or catalog errors.
We may restrict or terminate access when fraud, abuse, misuse, or a violation of these Terms is suspected.
3. Accounts and Customer Information
You may order as a registered customer or guest. You are responsible for providing accurate, complete, and current billing, shipping, payment, telephone, and email information and for safeguarding account credentials. We are not responsible for delays, failed deliveries, or losses caused by inaccurate information supplied by a customer.
4. Orders and Order Acceptance
Submitting an order is an offer to purchase. An automated order confirmation only acknowledges receipt of the order; it is not final acceptance or a promise to fulfill the order. A payment authorization, pending payment, estimated delivery date, or order status of “authorized,” “confirmed,” or “processing” does not mean an order has been accepted.
All orders are subject to product and SKU verification, price verification, inventory and supplier availability, payment authorization, fraud review, shipping availability, manufacturer or distributor restrictions, and final acceptance by RV & Auto Parts.
Unless we expressly state otherwise in writing, an order is accepted when the product ships and a shipping confirmation is issued. We may refuse, limit, place on hold, or cancel an order before shipment.
5. Pricing, Product Information and Catalog Errors
We make reasonable efforts to display accurate information. However, product data may be supplied or updated by manufacturers, distributors, data providers, software integrations, and other third parties. Errors may occur in prices, descriptions, images, specifications, dimensions, fitment, manufacturer part numbers, SKUs, UPCs, product associations, package quantities, inventory, availability, promotions, or shipping charges.
A product may be associated with the wrong SKU, image, description, part number, price, or inventory record. An order confirmation does not require us to provide a different or higher-value product that was incorrectly connected to the ordered SKU.
We may correct an error and refuse or cancel an affected order before shipment even if the order was confirmed, payment was authorized or collected, or an estimated delivery date was provided. If canceled, we will void the authorization or refund the amount collected to the original payment method.
We are not obligated to honor an erroneous price, provide an incorrectly displayed product, substitute another product, or reimburse a price difference elsewhere. Nothing in this section limits any non-waivable right under applicable law.
6. Product Images, Descriptions and Packaging
Product images may be representative rather than exact. Packaging, labels, colors, finishes, included accessories, and minor details may change without notice. Unless expressly stated otherwise, the manufacturer’s current part number and specifications control over an illustrative image or general description. Customers should verify part numbers and specifications before ordering.
7. Vehicle and Equipment Fitment
Fitment tools, application guides, search results, recommendations, and artificial-intelligence tools are provided as a convenience and may not account for every production change, trim level, engine, chassis, submodel, modification, or prior repair.
Before ordering, the customer is responsible for verifying the manufacturer part number, vehicle information, measurements, specifications, installation requirements, applicable restrictions, and compatibility with existing equipment. Contact us before ordering when uncertain. A product is not defective solely because it was ordered for an incompatible application.
8. Inventory and Availability
Displayed inventory may include stock held by us, manufacturers, distributors, fulfillment partners, or third-party warehouses. Inventory can change before our systems update, and a displayed quantity does not guarantee availability or reservation. We may cancel an order if a product is unavailable, discontinued, restricted, recalled, backordered, or unavailable from the expected fulfillment source.
9. Payment and Authorization Holds
You authorize us and our payment processors to process charges connected with your order. A financial institution may place a temporary authorization hold. If an order is canceled before capture, we may void the authorization, but the financial institution controls when the hold disappears. If payment was captured, an approved refund will be issued to the original payment method. We are not responsible for bank fees, overdraft fees, financing charges, or processing delays imposed by third parties.
10. Cancellations
Customer Cancellation Requests
Contact us promptly to request cancellation. Cancellation is not guaranteed after processing begins, an order is submitted to a supplier, or shipment is prepared. Shipped orders must follow our Return and Refund Policies. Custom, special-order, made-to-order, personalized, final-sale, or supplier-restricted products may not be cancelable.
Cancellations by RV & Auto Parts
We may cancel an order before shipment because of a pricing or listing error, incorrect SKU or product mapping, incorrect supplier data, inventory unavailability, discontinuation, recall, payment issue, suspected fraud, shipping restriction, manufacturer restriction, obvious technical error, or operational limitation. Our obligation for a canceled order is limited to voiding the authorization or refunding the amount collected.
11. Shipping and Delivery
Processing times, shipping charges, delivery estimates, freight requirements, address restrictions, and damage procedures are governed by our Shipping Policy, incorporated here by reference. Delivery dates are estimates unless expressly guaranteed in writing. Customers must verify the shipping address before ordering. Address changes are not guaranteed after processing begins. Freight shipments should be inspected, with visible damage noted on the delivery receipt before signing.
12. Returns, Refunds and Exchanges
Returns and refunds are governed by our Return Policy and Refund Policy, incorporated here by reference. A return authorization does not guarantee a refund; returned products are inspected. Used, installed, altered, damaged, incomplete, late, unauthorized, or improperly packaged returns may be refused or subject to lawful deductions. Original and return shipping charges may be nonrefundable unless the return results from our verified error, covered shipping damage, or applicable law.
13. Damaged, Defective, Missing or Incorrect Products
Inspect deliveries promptly. Report damage, defects, shortages, missing components, or incorrect products within the period stated in our Return or Refund Policy. We may require photographs of the product, manufacturer labels, part numbers, shipping labels, packaging, carton damage, and everything received. Do not install, use, modify, discard, or dispose of a product after discovering a problem unless we instruct you in writing. Continued use or installation after discovery may affect return eligibility, except where prohibited by law.
14. Payment Disputes and Chargebacks
If you believe an order, product, delivery, refund, or payment is incorrect, you agree to make a good-faith attempt to contact RV & Auto Parts before initiating a chargeback or payment dispute and to provide us a reasonable opportunity to investigate and resolve the issue.
Contacting a bank, card issuer, PayPal, financing provider, or other payment service does not cancel an order, create a return authorization, excuse compliance with our return procedures, or permit you to keep both the merchandise and the purchase funds.
If you initiate a dispute, you agree to provide truthful and complete information to the payment provider. You must not characterize an authorized purchase as unauthorized, claim non-delivery after confirmed delivery, claim that an item was not as described without first allowing reasonable review, or seek duplicate recovery through both a refund and a payment dispute.
We may contest a chargeback or payment dispute and provide the payment provider with relevant records, including these accepted Terms, order details, product listings, payment authorization, fraud-screening information, IP or device information where lawfully collected, customer communications, shipment records, tracking, proof of delivery, photographs, return records, and refund records.
If a payment provider issues a temporary credit, that credit is not a final determination that money is owed. If a chargeback is denied or reversed, any unpaid order balance remains due. Where permitted by law and applicable payment-network rules, we may seek recovery of merchandise, unpaid balances, duplicate refunds, and reasonable costs resulting from fraudulent or bad-faith disputes.
Nothing in this section prevents a customer from exercising a valid, non-waivable right under applicable law or applicable card-network rules.
15. Warranties
Products may be covered by manufacturer warranties controlled by the manufacturer’s terms. Except for warranties expressly provided by us in writing and rights that cannot legally be excluded, products and website services are provided on an “as available” basis. We do not guarantee that every product is appropriate for every intended application.
16. Promotions, Discounts and Quantity Limits
Promotions, coupons, rebates, free-shipping offers, and special pricing may have separate terms, expiration dates, exclusions, geographic restrictions, minimums, and quantity limits. Promotions may not be combined unless stated. We may correct or cancel a promotion affected by fraud, abuse, obvious error, or technical malfunction. We may limit quantities or refuse orders intended for unauthorized resale, export, diversion, marketplace manipulation, or circumvention of manufacturer restrictions.
17. Third-Party Services
Our website may connect to payment providers, financing providers, manufacturers, carriers, marketplaces, review services, fitment providers, and other third parties. We are not responsible for their content, availability, security, accuracy, or independent practices. Separate terms and privacy policies may apply.
18. Reviews and Customer Content
Content you submit must be accurate, lawful, and non-infringing. You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and distribute submitted content for business and promotional purposes, subject to applicable law and our Privacy Policy. We may remove fraudulent, abusive, unlawful, unrelated, or privacy-violating content, but do not remove reviews merely because they express a negative opinion.
19. Intellectual Property
Website text, logos, graphics, photographs, layout, software, and original materials are owned by or licensed to RV & Auto Parts and protected by applicable law. Manufacturer names, trademarks, images, and part numbers belong to their respective owners. Website content may not be copied, republished, or commercially exploited without authorization except as permitted by law.
20. Electronic Communications, Mobile Messages and Privacy
By communicating with us electronically, you consent to receive order-related records and notices electronically. Marketing emails and texts require the applicable consent and may be stopped using the instructions in the message. Marketing consent is not a condition of purchase. Message and data rates may apply.
Our handling of personal information is governed by our Privacy Policy, incorporated here by reference.
21. Limitation of Liability
To the fullest extent permitted by law, RV & Auto Parts is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or products. We are not responsible for damage caused by incorrect installation, improper use, unauthorized modification, failure to follow manufacturer instructions, incompatible applications, ordinary wear, or independent third parties.
To the fullest extent permitted by law, our total liability relating to an order will not exceed the amount paid to us for the product giving rise to the claim. These limitations do not apply where liability cannot legally be limited or excluded.
22. Indemnification
To the extent permitted by law, you agree to indemnify and hold RV & Auto Parts Inc., its owners, employees, agents, and service providers harmless from third-party claims arising from your unlawful use of the website, violation of these Terms, misuse of a product, or infringement of another person’s rights.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. A dispute not resolved informally will be handled in a court with proper jurisdiction, subject to rights and procedures that cannot lawfully be waived.
24. Severability and No Waiver
If a provision is invalid or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain effective. Failure to enforce a provision does not waive our right to enforce it later.
25. Changes to These Terms
We may update these Terms periodically. Updated Terms become effective when posted unless a later date is stated. The Terms in effect when an order is submitted will generally govern that order. Changes will not be applied retroactively where prohibited by law.
